Terms of Service

TL;DR

  • You own your notes. We only use them to run the app for you.
  • The AI isn't always right. Check anything important before acting on it.
  • Don't abuse the service. No illegal use, no trying to break it, no harassing other users if you share notes.
  • You can cancel any time. Subscriptions bought in the App Store or Play Store are managed there.
  • Consumer rights are preserved. Nothing in these terms takes away rights you have under Australian Consumer Law or equivalent laws where you live.

1. Who these terms are with

Loose Tongues is a one-person operation run by Stephen Simpson, a sole trader based in Australia. These terms ("Terms") form an agreement between you and Stephen when you use the Loose Tongues mobile or web app or the service at loose-tongues.com (together, the "Service"). By using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

2. Your account

You need an account to use most of the Service. You're responsible for keeping your sign-in credentials secure and for everything that happens under your account. Tell us straight away if you think someone else has gained access. You must be old enough to enter into a contract in your country (13+ as a general minimum, 16+ in some jurisdictions).

3. Your content

Anything you record, transcribe, type, or create in the Service — audio, transcripts, notes, rewrites — is your content. You keep all ownership rights in it.

You grant us a limited, non-exclusive, worldwide, royalty-free licence to store, copy, transmit, process, display, and modify your content only to the extent needed to operate the Service for you — for example, to store notes, generate transcripts, run AI rewrites and Ask AI, back up data, and share a note with collaborators you invite. This licence ends when you delete the content or your account. We don't use your content to train AI models and we don't sell it.

You're responsible for your content. Don't upload material you don't have the right to use, record, or share.

4. AI output

The Service uses AI models (including Google's Gemini) to generate transcripts, rewrites, summaries, and answers. AI output can be wrong, incomplete, or make things up. It is provided for your convenience, not as professional advice. Don't rely on AI output for medical, legal, financial, or other important decisions without verifying it yourself.

5. Acceptable use

You agree not to:

  • Use the Service to do anything illegal, or to record anyone without the consent required by the law where you live;
  • Upload content that's abusive, threatening, defamatory, or that infringes someone else's rights;
  • Try to break, probe, overload, or reverse-engineer the Service, or bypass our security or rate limits;
  • Share your account, scrape the Service, or use it to build a competing product;
  • Use the Service to train your own AI models on the output we provide.

We can remove content or suspend access if we reasonably believe you've broken these rules.

6. Paid plans, subscriptions, and refunds

Some features are available only on a paid plan. Prices are shown in the app or on loose-tongues.com. Taxes may apply depending on where you live.

App Store and Play Store subscriptions. If you subscribe through the Apple App Store or Google Play, your subscription is billed and managed by Apple or Google respectively, under their terms. You can cancel or request a refund through your App Store or Play Store account; we can't process those refunds directly.

Web subscriptions and one-off payments. For payments made directly through our website (if offered), you can cancel any time and your plan will end at the end of the current billing period. You can request a refund within 14 days of your initial purchase by emailing hello@loose-tongues.com, provided you haven't made substantial use of the paid features. This refund option is on top of any rights you have under consumer law (see §11).

7. Changes to the Service

The Service is under active development. We may add, change, or remove features, and we may change or retire parts of the Service at any time. If we make a change that materially removes a feature you pay for, we'll make it right — typically by continuing it until the end of your current period, offering a refund, or providing a comparable alternative.

8. Apple App Store

If you downloaded the app from the Apple App Store, these additional terms apply:

  • These Terms are between you and us only — Apple is not a party and is not responsible for the app or its content.
  • Apple has no obligation to provide support or maintenance for the app.
  • Apple is not responsible for product warranty claims, product liability claims, or third-party intellectual-property claims relating to the app, subject to Apple's own refund policy.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

9. Intellectual property in the Service

The Loose Tongues app, website, branding, designs, and underlying code are ours (or our licensors'). Nothing in these Terms transfers any of that to you. You may use the Service as intended; you may not copy our code, resell the Service, or reuse our branding.

10. Disclaimers

We provide the Service "as is" and "as available", without warranties of any kind except those we can't exclude by law. We don't guarantee the Service will be uninterrupted, error-free, or that AI output will be accurate or fit for any particular purpose. Make your own backups of anything important.

11. Consumer rights

If you're a consumer in Australia, our goods and services come with guarantees under the Australian Consumer Law that can't be excluded. These Terms don't limit those rights. The same applies to equivalent non-excludable rights you may have under the law where you live (for example, under EU or UK consumer law).

12. Limitation of liability

To the maximum extent allowed by law, and subject to §11, we won't be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, revenue, or goodwill.

Our total liability to you for all claims arising out of or related to the Service in any 12-month period is capped at the greater of (a) the amount you paid us for the Service in that period, or (b) AUD $100.

13. Suspension and termination

You can stop using the Service at any time. You can delete your account by emailing privacy@loose-tongues.com; an in-app option is on the roadmap.

We may suspend or terminate your access if you materially break these Terms, if we need to protect the Service or other users, or if we're required to by law. Where reasonable, we'll give you notice first. On termination, your licence to use the Service ends and — unless you've asked us to delete it sooner — we'll retain your content only for as long as described in the Privacy Policy.

14. Governing law

These Terms are governed by the laws of Australia. You and we agree to submit to the non-exclusive jurisdiction of the courts of Australia for any dispute — which means you can still bring a claim in your local courts if the law where you live gives you that right.

15. Changes to these Terms

We may update these Terms as the Service evolves or as the law requires. When we make material changes, we'll tell you in the app or by email and update the "last updated" date at the top of this page. Continuing to use the Service after a change means you accept the updated Terms.
